Terms of service

Agreement

These Terms of Service (“Terms”) are a contract between you and Boson governing access to and use of getboson.com, app.getboson.com, our APIs, documentation, and the Boson agent (the “Services”). By creating an account, installing the agent, or otherwise using the Services, you agree to these Terms.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

The Services

Boson provides a control plane and outbound agent that help you deploy and observe containerized workloads on servers you operate. Features, limits, and availability may change as we develop the product. Preview or beta features may be incomplete, unsupported, or withdrawn at any time.

Accounts and eligibility

You must provide accurate account information and keep credentials confidential. You are responsible for activity under your account and workspaces, including actions taken by members you invite and agents you pair.

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Services.

Your infrastructure and content

You retain ownership of your code, container images, configuration, and data on your infrastructure (“Customer Content”). You grant Boson a limited license to process Customer Content and metadata only as needed to provide the Services you enable (for example storing deploy status, streaming deploy logs you initiate, and retaining gateway metrics according to your settings).

You are solely responsible for your VPS providers, operating systems, firewalls, backups, application security, secrets management, and compliance obligations related to Customer Content and end users of your applications.

Acceptable use

You will not misuse the Services. Prohibited conduct includes attempting to access other customers’ data or systems; probing or attacking our infrastructure except through authorized security programs; distributing malware; mining cryptocurrency on shared resources we operate; using the Services to violate law; reverse engineering the Services except where such restriction is prohibited by law; or reselling the Services without our prior written consent.

Agents, tokens, and access

Join tokens and agent credentials are confidential. You must revoke compromised tokens and decommission agents on retired machines. You authorize outbound connections from agents you install to our control plane.

Fees

Paid plans, if offered, are described in the product or an order form. Fees are non-refundable except where required by law or expressly stated otherwise. We may change pricing with notice for future billing periods. You are responsible for taxes excluding taxes on our income.

During preview periods we may provide access without charge. Free or preview access may be limited, throttled, or ended.

Intellectual property

Boson and its licensors own the Services, including software, branding, and documentation. These Terms do not transfer ownership of our IP to you. Feedback you provide may be used by us without obligation to you.

Third-party services

The Services may interoperate with third-party products (for example Git hosts, container registries, or cloud VPS providers). Your use of those products is governed by their terms. We are not responsible for third-party services.

Confidentiality

Each party may receive non-public information from the other. The receiving party will use that information only to perform under these Terms and will protect it with reasonable care. Confidentiality obligations do not apply to information that is public, independently developed, or rightfully received from a third party without duty of confidentiality.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEPLOYS OR METRICS WILL BE COMPLETE OR ACCURATE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOSON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

Indemnity

You will defend and indemnify Boson against claims arising from your Customer Content, your applications or end users, your misuse of the Services, or your violation of these Terms or applicable law.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to address security risk or non-payment. Upon termination, your license to use the Services ends. Sections that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.

Changes

We may modify these Terms by posting an updated version. Continued use after the effective date constitutes acceptance of the changes, except where applicable law requires additional consent.

Governing law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in Wilmington, Delaware will have exclusive jurisdiction, subject to any non-waivable local venue rights.
